Upside Down Court

The United States Supreme Court has a legitimacy problem
The United States Supreme Court has a legitimacy problem

The United States Supreme Court has had its moments of scandal and embarrassment throughout its 235 year history. Infamously, there was the Dred Scott decision, in which the court dehumanized Black people, labeling them as 3/5ths human, and then denying them their Constitutionally protected rights. Another of the courts many blemishes include Plessy vs Ferguson, an 1896 ruling that upheld racial segregation. Then there was the Citizens United ruling in 2010, which granted corporations the constitutionally protected rights, the court had so often denied minorities. The ruling allowed for corporations to be seen as citizens with the ability to sway elections with billions of dollars for their favorite candidates, usually and most often Republicans. No one will soon forget the year 2000 when the Supreme Court decided the United States election. Despite the fact that Vice President Al Gore had won the popular vote and was winning every recount, the court halted the election, awarding the presidency to George W. Bush. Bush was selected to be President of the United States by justices who were nominated by his own father, President George H.W. Bush. Despite all of this egregiousness, the Supreme Court's legitimacy is called into question now more so than ever before.

George W. Bush was hand-picked to be President of the United States, by the United States Supreme Court.

The Supreme Court has been marred by historically terrible decisions, made by men who were products of their time, but despite this, never lacked legitimacy as it does today. One third of the current court has been hand-picked by insurrectionist, convicted felon, rapist, and Russian asset Donald J. Trump. Two justices were nominated by the court's hand-picked Commander in Chief, President George W. Bush. Those are Federalist Society alums Samuel Alito and Chief Justice John Roberts. As Chief Justice, Roberts has a responsibility to hold the court accountable, to set standards and carry them out, but he too often negates such responsibility, tainting himself and the rest of the court as equally illegitimate.

George W. Bush justice Samuel Alito is a proud supporter of all things Russian, especially January 6th insurrectionism. A Christian Nationalist, Alito flew an inverted flag on January 6th, in support of those who attempted to overthrow the United States government. Also flown was the Appeal to Heaven flag, a Christian Nationalist flag adopted by January 6th insurrectionists, who wish to overthrow the American government and replace it with a Christo-fascist regime. These flags flew over Alito's home while the Supreme Court was considering presiding over a 2020 election case. It should be noted that Alito desired the court to become involved in the election but was overruled by other members. The Supreme Court will also soon be hearing two cases regarding the January 6th insurrection, including whether former President Trump has complete immunity for his actions in support of the overthrowing of the United States government. Chief Justice Roberts, who infamously said the court would police itself, has negated his own responsibilities and refused to investigate the matter.

Although the New York Times found out about Alito's support for insurrection more than three years ago, the anti-Biden newspaper kept the story hidden until only recently. Once everything finally came to light, Alito blamed his wife and her own political leanings for the flags,

"I had no involvement whatsoever in the flying of the flag. It was briefly placed by Mrs. Alito in response to a neighbor's use of objectionable and personally insulting language on yard signs."

The "objectionable" content Alito references could include pride flags flown at a neighbor's home. Thanks to investigative reporter Lauren Windsor we now know that the flags drew the ire of Alito's bigoted wife, Martha-Ann who was caught saying the following,

"I want a Sacred Heart of Jesus flag because I have to look across the lagoon at the pride flag for the next month."

The Supreme Court will decide on Obergefell vs Hodges as soon as next year. The 2015 ruling allows for the right of homosexuals to marry, but as was the case with Roe vs Wade and abortion rights, it is expected the ruling will be overturned by this ultra right-wing court, which thanks to the illegitimately elected Russian asset Donald J. Trump, now has a 6-3 far-right advantage.

The Alito's are religious and not merely so. Their faith isn't mild mannered or innocuous. They aren't going to Church merely to pray or participate in bake sales for charity. Their faith comes with a sword. For Samuel and Martha-Ann, Christianity includes the taking of power, and by force, if necessary. This is in adherence with what they believe to be God's command to take dominion over the Earth. Alito, who believes America is exclusively a Christian nation, admitted to the same reporter that he lacks impartiality with the left and sees the culture wars as a matter of winning or losing. This is a Supreme Court Justice admitting he lacks the impartiality to carry out his responsibilities to the United States Constitution.

Alito isn't the only bad egg on the court, just the current most glaring one. George H.W. Bush nominee Clarence Thomas has received over $4 million in gifts (a.k.a. bribes) since he took office in 1991. Included in those $4 million in gifts were many trips and lavish vacations given by billionaire Republican business-man Harlan Crow. Crow, a great admirer of dictators like Vladimir Putin, also has one of the world's largest Nazi memorabilia collections.

Thomas' wife, Ginni, also strikes at the heart of credibility for the court. She is a proud insurrectionist, supporting the events at the Capitol building on January 6th. Ginni Thomas is a friend of Donald Trump's, and regularly communicated with the former President, providing him with lists of people she considered disloyal to the cause of overthrowing American democracy. Ginni also was once a prominent member on Turning Point USA's advisory council, an organization that sent more than 80 buses to Washington D.C., each filled with violent insurrectionists intent on overthrowing the American government. It was Ginny Thomas, who wrote the following to Trump Chief of Staff Mark Meadows, after the 2020 election,

"Do not concede. It takes time for the Army, who is gathering at his [Trump's] back."

It was Ginny Thomas who referred to Joe Biden's election in 2020 as, "the end of America."

Then there's Trump appointee Neil Gorsuch, who sold property to lawyers arguing before the court. Fellow Trump appointee Brett Cavanaugh was as much as $200,000 in debt, but by the time of his controversial nomination in 2018 that debt mysteriously vanished without explanation. Perhaps Chief Justice Roberts is hesitant to investigate any of these matters because of what he may find out about his own wife, Jane. Jane Roberts works as a legal recruiter making millions selling access to - you guessed it - the United States Supreme Court.

None of this bodes well for the future, of course, and especially the 2024 election. One of Vladimir Putin's plans for the United States is to have the election decided by the courts. Whether Donald Trump has the votes for election is irrelevant when he has the loyalists he needs to accomplish his most nefarious goals in the court. With a 6-3 Supreme Court majority, it is possible - even likely - that the Supreme Court will decide the 2024 election, and when that time comes, Donald Trump believes he can count on the loyalty of the justices he has appointed, as well as supporters like Clarence Thomas, to deliver the White House. The Supreme Court's illegitimacy makes democracy a virtual impossibility.

House Minority Leader Hakeem Jefferies said the following,

"The Supreme Court is not above the law. Congress must immediately consider legislation to implement an ethical code of conduct. And make clear that sympathizing with violent insurrection is not acceptable."

Such a code would help preserve democracy, but its implementation is easier said than done with a conservative majority in the House of Representatives. Russia owns many American congressmen, both on the far left and the far right. Russian owns the majority of the Supreme Court and Russia once again has its eyes set on the White House. Only the American people can prevent the fascist takeover of American democracy by electing pro-Democracy Democratic leaders at every branch of government. The 2024 election must be such a resounding victory that no court would dare to intervene. Voters must come out in droves to denounce Russia, so that Trumpism may finally die the death it deserved so long ago in 2016. Short of that, and democracy dies. Short of that, and the country Reagan once called the shining city on the hill dies. It's America or Trumpism, but both cannot co-exist.
